Step 3 of 4 — The Reality Check

Here is who actually steps in if there's no LPA in place.

Right now, in the eyes of UK law, if you lost capacity tomorrow, NONE of the people in your Circle would have the automatic legal authority to make decisions about your money. Not your partner. Not your adult children. Not your most trusted friend.

Here is who actually decides instead.

  • Your bank freezes your accounts the moment they have reason to think you cannot make decisions for yourself.
  • Your family applies to the Court of Protection. This can take 12 to 18 months and costs around £400 plus court fees.
  • A court-appointed Deputy (someone you may have never met) then makes decisions on your behalf, under court oversight.
  • Your Circle has no say unless they go to court for it.

You spent your whole life working out who you can trust. Do not let a court choose for you.

Step 4 of 4 — Ready to put your people in charge?

A Lasting Power of Attorney puts the people you trust in the legal driver's seat.

If anything happens, they don't need to fight a court. They simply step in and act for you exactly as you'd like them to.
